Kolkata High Court : After 27-Year Struggle, Son Secures Father’s Job in Kolkata Corporation

News Desk, Kolkata :  In 1996, the esteemed Harendranath Nayak, father of Ujjwal Nayak, faced a severe health setback. Tragically, in 1997, he succumbed to his illness. According to Kolkata Municipal Corporation regulations, if someone becomes physically disabled or passes away, a special provision mandates offering a job in the corporation to one family member. Ujjwal Nayak, after 27 years of relentless struggle, secured a position following his father’s passing. The Kolkata High Court directed the municipal corporation to expedite the process, and within the next 8 weeks, Ujjwal Nayak found himself employed.

The Nayak family hailed from the Tiljala region of Kolkata, and Harendranath Nayak, Ujjwal’s father, held the position of Tax Collector at the Kolkata Municipal Corporation. Ujjwal Nayak’s journey to employment involved numerous attempts and even appearances at the Kolkata High Court. Despite his long-standing efforts, the family received no pension or benefits, only a one-time payment of Rs. 44,997.

In 2014, Ujjwal Nayak attained a significant milestone by securing a job at the Kolkata High Court, marking a historic moment for the Nayak family. The case was heard by Justice Soumitra Pal’s bench. Despite the High Court’s directive to the municipal corporation to consider Ujjwal Nayak’s application, it was initially rejected in 2014. This led to Ujjwal Nayak again approaching the Kolkata High Court. This time, the case landed in the bench of Justice Sougata Bhattacharya. Expressing dissatisfaction over the corporation’s dismissal of the notice, Justice Bhattacharya voiced his disapproval.

Ujjwal Nayak, a tenacious fighter, was represented by lawyer Ashish Kumar Choudhury. Choudhury highlighted that the Kolkata Municipal Corporation’s committee had recommended Ujjwal Nayak’s name for the job, considering him eligible. Furthermore, a notice issued in 2009 was withdrawn in 2014, declaring Ujjwal Nayak fit for employment. Justice Sougata Bhattacharya, acknowledging the circumstances, directed the corporation to offer Ujjwal Nayak a job within 8 weeks.

This legal battle not only showcased Ujjwal Nayak’s determination but also shed light on the bureaucratic hurdles within the Kolkata Municipal Corporation. The struggle for justice took an unexpected turn in the courtroom, revealing the complexities of administrative procedures.

Ujjwal Nayak’s journey to employment was a testament to his resilience and the unwavering support of his family. The Kolkata Municipal Corporation, under the scrutiny of the High Court, had to rectify its previous dismissal and recognize Ujjwal Nayak’s rightful claim to the job.
